Uber Fined $966m Over Automated Driver Suspensions – Innovation Village

The Dutch Data Protection Authority (Autoriteit Persoonsgegevens or AP) has hit Uber Technologies Inc. with an €825 million ($966 million) fine for using automated algorithms to deactivate and suspend driver accounts without proper human oversight.

The penalty marks the second-largest fine ever issued under Europe’s General Data Protection Regulation (GDPR), trailing only the landmark €1.2 billion penalty levied against Meta in 2023.

Key Findings & Regulatory Directives

The regulatory investigation originated from a complaint filed by 171 drivers represented by the French human rights organization Ligue des droits de l’Homme. Because Uber operates its European operations out of its regional headquarters in Amsterdam, the Dutch watchdog spearheaded the enforcement action under the EU’s “one-stop-shop” regulatory framework.

• Algorithmic Deactivations: Between 2018 and 2022, Uber’s automated systems flagged and suspended drivers for suspected fraudulent activity such as taking long detours to inflate fares or repeatedly canceling rides and permanently blocked drivers whose customer ratings dropped below a set threshold.
   
• Lack of Human Oversight: Algorithms executed suspensions and deactivations without prior review by a human operator, leaving impacted gig workers abruptly cut off from their primary source of income.
   
• Transparency Failures: Uber failed to inform drivers that these life-altering decisions were being made purely by software, leaving drivers unable to appeal or seek redress.
