President Donald Trump is acknowledging that his latest round of tariffs is designed to accomplish the same goal as an earlier policy the Supreme Court ruled illegal, even as his administration faces a fresh legal challenge over the matter.
In a Fox News interview, Trump said the legal defeat forced him to pursue a more complicated path to reach the same outcome. He noted that the Supreme Court ruled against his original tariff approach in a close decision, but said other legal avenues now allow him to achieve similar results, even if the process has become more cumbersome.
A new lawsuit raises questions
Trump’s comments came just days after a federal lawsuit accused his administration of relying on different legal statutes as a workaround to revive the broader global tariff program that courts had already rejected. The nonprofit legal group behind the suit argued that changing the legal justification for a tariff does not make an otherwise unlawful policy lawful. Following Trump‘s Fox News remarks, the organization’s leader said the president’s own comments strengthen their case, framing his statement as confirmation that the new tariffs are simply another route to the same result the Supreme Court blocked.
What the Supreme Court originally struck down
Earlier this year, the Supreme Court ruled against Trump‘s global “liberation day” tariffs, which had imposed a 10 percent baseline tariff on goods from most countries, along with higher individualized rates for dozens of trading partners. The ruling found that Congress had not authorized that broad tariff structure. Since then, the administration has pursued alternative legal justifications to keep similar trade measures in place.
