TikTok reach landmark $400 million privacy settlement – Innovation Village

TikTok and its parent company, ByteDance, have officially agreed to a massive $400 million settlement with the U.S. Department of Justice (DOJ) to resolve allegations of violating children’s privacy laws. The DOJ noted that this agreement marks one of the largest financial recoveries in the history of the Children’s Online Privacy Protection Act (COPPA).

Background of the 2024 Lawsuit

The settlement brings an end to a 2024 lawsuit initiated by the Justice Department under the Biden administration. The DOJ had accused TikTok of several serious COPPA violations that compromised the safety of young users, including:

  • Underage Accounts: Knowingly permitting children under the age of 13 to create standard TikTok accounts without parental consent.
  • “Kids Mode” Data Collection: Wrongfully harvesting personal data, such as email addresses, from children who were using the app’s restricted “Kids Mode”.
  • Ignoring Parents: Frequently failing to honor explicit requests from parents to delete their children’s accounts and associated data.
  • Prior Violations: Breaching the terms of an earlier 2019 Federal Trade Commission (FTC) consent decree that was established following ByteDance’s acquisition of the predecessor app, Musical.ly.

Breakdown of the Financial Penalty

The DOJ structured the historic penalty into two distinct tranches:

  1. Immediate Payment: TikTok is required to pay $300 million upfront.
  2. Conditional Payment: An additional $100 million will be paid once an order is entered to officially vacate the prior FTC consent decree regarding Musical.ly.
